Guarantees, separations, trusts and business deals often need legal advice alongside the finance. Circle Finance doesn't provide legal services. I can refer you to lawyers who look after the legal side, so it runs in step with your loan.
Your lending with Jenny is one part of the picture. Your lawyer closes the circle with guarantees, family and estate matters, and business law.
Closing the circle
The right loan, on the right legal footing.
A loan is only as sound as the documents behind it. Guarantees, settlements, wills and contracts all have to be right before you rely on them.
I look after the lending. A lawyer looks after the legal side. With you at the centre, we work to the same dates, so nothing is left waiting on the other.
What a lawyer looks after.
The lawyers I refer clients to help with the legal matters that most often sit alongside a loan. This is their work, not ours.
Guarantees
Independent advice before you put your name to someone else’s loan.
Advice for parents and family members guaranteeing a loan, including a first home loan with a family guarantee.
An explanation of what you are agreeing to, how much you could be liable for and how the guarantee can end.
The independent legal advice certificate many lenders ask a guarantor to sign before settlement.
Separation and family
Sorting out property when a relationship ends.
Property settlements, consent orders and binding financial agreements.
Advice on keeping the family home, selling it, or one person buying out the other.
Agreements before you buy a property together.
Wills and estates
Making sure the home you have worked for goes where you intend.
Wills, including updating your will after you buy a property, marry or have children.
Enduring powers of attorney and appointing a medical treatment decision maker.
Probate and estate administration, including property held in an estate.
Business and commercial
The legal side of buying, leasing and running a business.
Reviewing commercial leases before you sign or commit to a fit-out.
Buying or selling a business, and shareholder or business owner agreements.
Setting up companies and trusts, and advice on borrowing through them.
Where your loan and legal advice meet.
These are the moments a lender will usually want the legal side settled first.
Guarantor sign-offMany lenders won’t settle a guaranteed loan until the guarantor has had independent legal advice. Your lawyer gives the advice and signs the certificate; I make sure the lender has what it needs, on time.
Refinancing after separationA lender usually needs the property settlement agreed before one person can take over the loan. Your lawyer handles the agreement; I arrange the refinance to match it.
Borrowing through a trust or companyLenders check the trust deed or company documents before they approve. Your lawyer prepares or reviews them; I make sure they suit the loan.
Leases and business purchasesCommercial loans and fit-out finance often depend on the lease or sale contract. Your lawyer reviews the terms; I line up the finance around the same dates.
How a referral works.
Simple, optional and only with your permission.
Jenny
1. Tell me what you need
Mention it when we talk about your loan, or choose “A referral to a lawyer” when you enquire. Earlier is better, before you sign or settle.
2. I refer you, with your permission
I only pass on your name, contact details and what you need help with, and only once you say yes.
3. The lawyer confirms their costs
They explain how they work and what it will cost before you engage them.
4. We keep each other updated
The legal advice is theirs. I look after the lending, and we keep the two in step through to settlement.
About lawyer referrals.
Does Circle Finance provide legal advice?
No. I am a lending specialist and Circle Finance is a credit representative. Legal advice comes from the lawyer you are referred to, under their own practising certificate.
Why does a guarantor need a lawyer?
A guarantee can make you responsible for someone else’s loan, so many lenders require the guarantor to receive independent legal advice first. The advice has to come from a lawyer acting for you, not the borrower or the lender.
What does a lawyer cost?
Each lawyer sets their own fees and must tell you how they charge before you engage them. Ask for an estimate and what it includes.
Do I have to use the lawyer you refer me to?
No. A referral is entirely optional, and it makes no difference to your loan or how I look after it. If you already have a lawyer, I will work with them.
Circle Finance is a credit representative. We do not provide legal services or legal advice. Legal advice is provided by the lawyer you are referred to, under their own practising certificate, and they will confirm their costs with you before you engage them. You are under no obligation to use them, and it does not affect your loan. This page is general information only and is not legal advice.
